Terms and Conditions for using the Albanian Alps APP
A. These Terms and Conditions contain the contractual terms according to which NACCON GmbH offers the application download, installation and use of digital products from the Google Play Store and the Apple Store. By choosing to download and install the application you accept these Terms and Conditions whereupon these Terms and Conditions will be legally binding to you. If you do not accept these terms you must not continue with the download.B. Any walks, which you take (whether on foot or by a means of transport) using our audio-tours, are undertaken entirely at your own risk. NACCON GmbH does not accept any responsibility for your personal safety, or for any loss or damage, which you might may suffer whilst using the Albanian Alps Guide application.
C. Users must remain stationary whilst listening to the audio guides and switch off their player and remove their headphones when moving. We do not take responsibility for the hazards encountered whilst walking. NACCON GmbH does not accept responsibility for any changes to the walking environment due to planning changes, changes in rights of way, building work, highway work or other obstructions and hazards temporary or otherwise, or inaccuracies in maps, audio, video, right-of-access information, disabled access, admission charges or opening times. At no point along any route should the app user be walking and listening at the same time.
D. Each Point of Interest (POI) is indicated on the map. Additionally, you may use the list of POIs to navigate through the POIs. The application includes the option to pause the player before setting off on your tour.
E. Please be responsibly aware of traffic while using the Albanian Alps Guide app. When crossing roads, use pedestrian crossings and pedestrian traffic lights correctly and only when permitted to do so. Always be wary of vehicles that may unexpectedly disobey red traffic lights and traffic safety regulations.
F. You are strongly advised to take out appropriate travel insurance before undertaking an Albanian Alps Guide tour.
G. We shall accept no liability towards you for any defect or failure of the Albanian Alps Guide app, if the defect or failure arises from any alteration made to the Albanian Alps Guide app by you or by any third party, or any breach by you of these terms or use of the Albanian Alps Guide app with incompatible hardware. Make sure that the latest software updates are installed on your device.
H. All information on the Albanian Alps Guide is to the best of our knowledge correct at the time of recording. However, we do not provide any assurance that you will be able to access all or any part of the indicated POIs, or any attractions or venues referred to in the Albanian Alps Guide, due to the possibility of unexpected building works, route closures or control over pedestrian traffic by the authorities.
I. Audio files cannot be distributed, published on websites or other file sharing sites, broadcast, or altered in any way without permission from NACCON GmbH.
J. NACCON GmbH tries to make sure all information contained in the application is correct but does not accept any liability for any error or omission.
K. The application may contain links to external sites. NACCON GmbH has included links to these sites to provide users with information and services they may find interesting. NACCON GmbH is not responsible for the content of these sites or pages or for anything provided by external sites. NACCON GmbH cannot be made liable for any costs arising from using mobile devices / smartphones in the online mode and roaming mode.
L. NACCON GmbH is not liable for any action you may take as a result of relying on any information provided in this application.
Copyrights and Intellectual Property Rights
M. NACCON GmbH uses different sources such as Wikipedia, printed publications, videos, public libraries, expert knowledge, onsite visits and investigations for the development of the media files in the Albanian Alps Guide. If you believe you have identified any material such as text and pictures, which from your point of view may violate your intellectual property rights, please contact us with relevant evidence and documentation proving this violation. If your claim proves to be well founded, we will remove the content from the app immediately. NACCON GmbH cannot be held liable for third party violation of any intellectual property rights, if NACCON GmbH can prove that NACCON GmbH was compromised by contracted third parties despite its comprehensive quality-assurance system being in place.
N. All Intellectual Property Rights in Digital Products, any modification, adaptation, update, upgrade or improvement of the same belong to NACCON GmbH. A violation of the intellectual property rights will be brought before the court in Tübingen, Germany. All such Intellectual Property Rights of NACCON GmbH are hereby reserved.
O. NACCON GmbHSolely NACCON GmbH or its suppliers own all Intellectual Property Rights on content and other materials accessible on this application unless stated otherwise in the application. None of the content or the other materials may be copied or reproduced without the expressed consent of NACCON GmbH.
P. Except where expressly set out otherwise, users may not copy or use any material from the application without permission from NACCON GmbH. Users may not remove or change any copyright, trademark or other intellectual property right notices contained in the original material or from any material copied or printed off from the application or site. Users must only use the application and anything available from the application for lawful purposes and users must comply with all applicable laws, statutes and regulations.
Q. All intellectual property rights in any material (including maps, text, photographs and other images and sound, trademarks and logos) contained in this application and site are either owned by NACCON GmbH or have been licensed to NACCON GmbH by the rights’ owner(s) so that NACCON GmbH may use this material within this application. If you find that one or more of the materials contained are in breach of your copyright, please notify us to address this. Users are only allowed to use the application and the materials contained within, as set out in these Terms and Conditions. In cases of any unauthorized use of content we will take legal action against the party in breach of these property rights.
